Prosecutorial Misconduct – Medical Examiner Malfeasance in Mississippi

The medical examiner in the case, Dr. Steven Hayne, had testified under oath that he could tell from the bullet wounds in the body that Edmonds and his sister simultaneously held the gun to fire the fatal shot. Of course, as the court concluded, it is impossible to make such a determination from examining bullet wounds.

Former Columbus, Miss., Police Chief J.D. Sanders has been trying for years to draw attention to Dr. Hayne. “There’s no question in my mind that there are innocent people doing time at Parchman Penitentiary due to the testimony of Dr. Hayne,” he says. “There may even be some on death row.”

According to his comments on the stand, he performs anywhere from 1,500 to 1,800 autopsies a year. The National Association of Medical Examiners (NAME) says a medical examiner should perform no more than 250 autopsies per year. After 325, the organization refuses to certify an examiner’s practice.


The doctor perfoms 1,500 to 1,800 autopsies per year. At $550 per autopsy that works out to $990,000 per year. In addition to performing 28 to 34 autopsies per week he testifies in court, presumably as a paid expert witness 2 to 4 days per week, reducing the time available for the autopsies even further. One autopsy has been branded “near total speculation”.

This doctor is selling testimony that may well have put many innocent people in jail for life or on death row. People who actually committed the crimes for which they were found guilty in a court of law may eventually be released based on this doctors malfeasance.

There is plenty of blame to go around. The prosecutors are guilty of prosecutorial misconduct and the “good doctor” should have his license revoked.

Britsh MPs visiting the Pentagon to discuss America’s stance on Iran and Iraq were shocked to be told by one of President Bush’s senior women officials: “I hate all Iranians.” And she also accused Britain of “dismantling” the Anglo-US-led coalition in Iraq by pulling troops out of Basra too soon.The all-party group of MPs say Debra Cagan, Deputy Assistant Secretary for Coalition Affairs to Defence Secretary Robert Gates, made the comments this month.

RIAA Counterclaim for conspiracy to commit extortion upheld

The RIAA (Recording Industry Association of America) has a history of breaking into peopl’es computers, filing John Doe exploratory lawsuits and offering people a settlement in lieu of threatened fees of hundreds of thousands of dollars even when they know the defendants are not responsible.

It appears they may be getting their comeuppance.

The court sustained defendant’s counterclaims for

-trespass to defendant’s personal property based on the RIAA’s having accessed files on Ms. Del Cid’s computer without her permission,
-violation of the Computer Fraud and Abuse Act based on the RIAA’s unauthorized intrusion into defendant’s computer,
-violation of Florida’s Deceptive and Unfair Trade Practices Act,
-a declaratory judgment of non-infringement, and
-conspiracy to commit extortion, since defendant sufficiently alleged “a peculiar power of coercion possessed by Plaintiffs [by] virtue of their combination, which an individual alone would not possess”.

Cheney considered asking Israel to bomb Iran

Sun Sep 23, 2:34 PM ET WASHINGTON (Reuters) – Vice President Dick Cheney had at one point considered asking Israel to launch limited missile strikes at an Iranian nuclear site to provoke a retaliation, Newsweek magazine reported on Sunday….A military response by Iran could give Washington an excuse to then launch airstrikes of its own, Newsweek said.

Israel has declined to comment on the reported air strike, while Syria has denied receiving North Korean nuclear aid and said it could retaliate for the September 6 violation of its territory.

House MD and Don Burleson

On an episode of House this year, a guy and his girlfriend both vegans come in to the hospital to find out why the boyfriend’s bowel movements float. House explains that he is cheating “with another food group” and that his movements float because they are filled with fat from eating hamburgers.

This was an epiphany for me. For years I wondered how Don Burleson postings on Oracle Technology are top listings on Google searches when there are no links to the pages (using the google advanced search option you can find pages that link to a given page). Burleson is a clown of the first order. His technical advice is less than worthless, it is often dangerously wrong. If you are an Oracle professional you must expunge information you “learned” from Don Burleson’s postings and books.

If you are not an Oracle professional I won’t bore you with the details.

Anybody who’s blog slogan is “You have the right to my opinion” certainly has an inflated opinion of himself.

Now check out his posting on company dress code the number #1 result on a google search for the same. Maybe he is just a comedian, which would be fine, but this is also the host site for Rampant Press which publishes scores of books on technology.

In any event, I now know why his postings float to the top.

Bill O’Reilly – some blacks are just like humans

You gotta love Bill O’Reilly. He went to a restaurant in the north end of Manhattan and a whole bunch of black people were acting civilized.

O’REILLY: That’s right. That’s right. There wasn’t one person in Sylvia’s who was screaming, “M-Fer, I want more iced tea.” … And there wasn’t any kind of craziness at all.

A rare moment in U.S. History I’m sure.

After I posted this I ran across a related story, posting it here so it doesn’t get buried. More fair than Bill is with his guests.

Bill O is still an asshole, but in the interest of fairness, that quote was taken out of context, here is the story from the guy with whom Bill O was talking

So, O’Reilly says to me that the reality to black life is very different from the lowlife behavior glorified by the rappers. He told me he was at a restaurant in Harlem recently and there was no one shouting profanity, no one threatening people. Then he mentioned going to an Anita Baker concert with an audience that was half black, and in sharp contrast to the corrosive images on TV, well dressed and well behaved.

I joked with O’Reilly that for him, a guy from Long Island, a visit to Harlem was like a “foreign trip.” That’s when he brought up his grandma. He said she was prejudiced against black people because she knew no flesh-and-blood black folks but only the one-dimensional TV coverage of black criminals shooting each other and the rappers and comedians glorifying “gangsta” life and thug cool.
